These Terms & Conditions (“Terms”) govern your access to and use of the Kaboose App and the Kaboose Neuro Nuggets mobile application, and any related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

“Kaboose”, “we”, “us”, or “our” refers to Tribe Finder App Pty Ltd Trading As Kaboose (ABN 19 655 366 466). “You” or “User” refers to any individual or organisation accessing or using the Services.

1. Purpose of the Services

Kaboose provides an online platform offering community connection, microlearning content (including “Neuro Nuggets”), and general educational resources designed to support neurodivergent individuals and their Allies. The Services do not constitute medical, clinical, or psychological treatment. Content is for informational purposes only.

2. Acceptable Use of the Service

To use the Services, you must:

• be at least 18 years old (or the age of digital consent in your region);
• have the legal capacity to enter into these Terms; and
• provide accurate and complete information during registration.

You are responsible for your use of the Services, and for any use of the Services made using your account.  Our goal is to create a positive, useful and safe member experience.  To promote this goal, we prohibit certain kinds of conduct that may be harmful to other users or to us.  When you use the Services, you must comply with our House Rules.

Organisational users must ensure their staff use the Services in accordance with these Terms.

3. Account Registration and Security

When creating an account, you agree to:

• provide accurate, current, and complete information;
• maintain the confidentiality of your login details;
• accept responsibility for all activities conducted using your account;
• promptly notify us of any unauthorised access or security breach.

Kaboose may suspend or terminate your account for violations of these Terms or for activity that risks community safety.

4. Consent to Communications

By registering, you consent to receive communications from Kaboose, including but not limited to:

• service updates and important notices;
• community announcements;
• content release notifications (e.g., new Neuro Nuggets);
• reminders, surveys, and feedback requests.

You may adjust or disable notifications via your device settings.

5. Community Standards (House Rules)

Users must adhere to the following standards when accessing or interacting within the Services.
You agree to:

5.1 Respectful Conduct

• Treat all users with respect, kindness, and professionalism.
• Refrain from harassment, bullying, discrimination, or abusive behaviour.
  
  

5.2 Privacy and Confidentiality

• Do not screenshot, record, copy, or share posts, comments, videos, or any content created by other users.
• Do not disclose another user’s personal information without their explicit consent.
  
  

5.3 Appropriate Use

You must not:

• post harmful, illegal, or inappropriate content;
• engage in spamming, solicitation, or promotion of unrelated services;
• impersonate others or misrepresent affiliation with any person or organisation.

Kaboose reserves the right to remove content or suspend accounts that violate these standards.

6. Intellectual Property

All materials within the Services, including microlearning content, videos, scripts, text, graphics, design elements, branding, trademarks, and user interface are owned by Kaboose or licensed to Kaboose.

Except as expressly permitted by these Terms, you must not:

• copy, reproduce, download, screenshot, distribute, or share any content;
• record or save video content;
• use content for professional training, commercial purposes, or external presentations;
• reverse-engineer, modify, or create derivative works from the Services.

Organisations may not repurpose or use Kaboose content for internal training unless a formal licence or agreement is in place.

7. User-Generated Content

As a condition of submitting any ratings, reviews, comments, messages, ideas, suggestions, information, data, text, photographs, audio clips, video clips, or any other materials within the Kaboose App or Neuro Nuggets (“Content”), you grant Kaboose a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, transferable, and sublicensable licence to:

• use, reproduce, copy, adapt, modify, edit, combine, translate, distribute, publicly display, publish, and create derivative works from your Content;
• incorporate your Content into other Kaboose or Neuro Nuggets materials, features, programs, or products; and
• sublicense the Content through multiple tiers for the purposes of operating, improving, developing, promoting, and maintaining the Service.

You acknowledge that this licence cannot be revoked once your Content is submitted.

You represent and warrant that:

• you own or have obtained all rights necessary for the Content you submit to be used by you, Kaboose, and other users as contemplated in these Terms;
• your Content does not infringe upon the intellectual property, privacy, publicity, or other rights of any third party; and
• your Content complies with all applicable laws and with our Community Guidelines / House Rules.

You understand that Content submitted within the Kaboose App or Neuro Nuggets may be visible to other users, and that neither Kaboose nor other users are required to maintain the confidentiality of your Content.

Prohibited User Content

You agree not to upload, publish, share, or provide any Content that:

• is defamatory, abusive, threatening, harassing, hateful, discriminatory, harmful, or otherwise violates the rights of any person or breaches any law;
• includes misinformation, health claims, or advice that may cause harm or distress;
• infringes any copyright, trademark, trade secret, privacy, publicity, or other proprietary rights of any party;
• in Kaboose’s reasonable judgment, is inappropriate, harmful, misleading, or interferes with the experience or safety of other users;
• violates these Terms, our House Rules, or any applicable policies;

• includes advertising, spam, unauthorised promotions, or commercial solicitations;
• attempts to collect information about other users; or
• includes content copied or extracted from Neuro Nuggets learning modules, scripts, or materials (as these are protected intellectual property and may not be shared, reproduced, or distributed).

Kaboose reserves the right to remove, disable, or restrict any Content that violates these Terms or is otherwise harmful to the community.

8. Data Deletion and Account Termination

8.1 User-Initiated Deletion

You may request deletion of your account and personal data at any time by:

using the in-app deletion option, or

emailing hello@kaboose.app

Once processed, your data will be permanently deleted except where retention is required for legal, regulatory, or safety purposes.

8.2 Kaboose-Initiated Termination

Kaboose may suspend or terminate access to the Services:

• if you breach these Terms;
• if your behaviour risks community safety;
• if required for legal compliance;
• if the Services are discontinued.

9. Service Availability and Changes

Kaboose may:

• update, modify, or discontinue parts of the Services;
• conduct maintenance that temporarily affects access;
• introduce new features or restrictions.

We will endeavour to provide notice for significant changes but cannot guarantee uninterrupted service.

10. Disclaimers

To the maximum extent permitted by law:

the Services are provided on an “as is” and “as available” basis;

Kaboose makes no warranties regarding accuracy, reliability, or suitability of content;

content is educational and not a substitute for professional clinical, medical, or psychological advice.

Users should seek professional support where necessary.

11. Limitation of Liability

To the extent permitted by law, Kaboose is not liable for:

• indirect, incidental, or consequential damages;
• loss of data, profit, or reputation;
• actions of other users;
• reliance on information provided within the Services.

Your sole remedy for dissatisfaction with the Services is to discontinue use.

12. Indemnity

You agree to indemnify and hold Kaboose harmless from claims, losses, liabilities, and expenses arising from:

• your use of the Services;
• any content you submit;
• breach of these Terms;
• violation of the rights of others.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Kaboose Pty Ltd is registered in Australia.

Disputes shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

Kaboose may amend these Terms at any time. Changes will be posted on the website or notified in-app.

Continued use of the Services constitutes acceptance of revised Terms.
